Strix Cloud Privacy Policy

a. Appropriately obtaining and using personal information

SoftGear Co., Ltd. (the “Company”) obtains users’ personal information set out in this Privacy Policy through Strix Cloud and uses that personal information only for the purposes of use set out herein.

b. Purposes of use of personal information

The categories of personal information that the Company obtains through Strix Cloud and the purposes of use for each category of personal information are as follows.
(1) Personal information of users (for corporations, the responsible personnel) entered during initial registration (name, job title, email address, address, etc.):
• For registering users as contracted users;
• For collecting debts from users; and
• For responding to user inquiries to the Company.
(2) Credit card information (expiration date, security code, objective of payment, and payment amount):
• For user payments of service fees for Strix Cloud.
(3) IP addresses and access logs (records of when Strix Cloud was used, which features were used, etc.) for the devices of users who use Strix Cloud:
• For confirming the appropriate usage of Strix Cloud by users (including confirming service fees for Strix Cloud);
• For providing users with support in using Strix Cloud;
• For identifying causes of and resolving server problems, etc.; and
• For using as statistical data.

c. Use of cookies

Strix Cloud may use cookies. Cookies are small pieces of data sent to the browsers of users who use Strix Cloud and are used for the following purposes:
(1) For identifying devices used by users;
(2) Together with access logs, for identifying the number of users who have used Strix Cloud with greater accuracy;
(3) Together with access logs, to check what pages on the Company’s site were viewed by users;
(4) For determining that users are logged in to Strix Cloud servers for services requiring users to log in;
(5) For conducting analysis on user access to Strix Cloud using Google Analytics or other website analysis tools (for information on the collection and processing of data by Google Analytics, please refer to the page “How Google Uses Information from Sites or Apps that Use Our Services” at: www.google.com/intl/en/policies/privacy/partners/); and
(6) For delivering behaviorally targeted advertisements to users.
Some browsers have settings that can be configured to not receive cookies sent from the Company’s site. In this case, some functions of Strix Cloud may be limited or may not work properly.

d. Legal compliance and security measures

The Company complies with the Act on the Protection of Personal Information (Act No. 57 of 2003) and all other laws, ordinances, and guidelines in relation to the handling of personal information.
The Company takes reasonable structural, human, and technical security measures in order to prevent any unauthorized access to and any leakage, loss, or damage of personal information.

e. Provision to third parties

Other than as permitted by law and ordinance, the Company does not disclose or provide personal information of users to third parties other than entities to which the Company entrusts its business (“Entrusted Entities”) without users’ prior consent. When providing personal information to Entrusted Entities, the Company imposes obligations to protect personal information on those Entrusted Entities through confidentiality agreements and the like, and the Company conducts proper management to ensure that the Entrusted Entities appropriately handle personal information. Users consent that when it is necessary for the Company to entrust its business to Entrusted Entities in order for the Company to provide Strix Cloud services, the Company may provide personal information of users to the Entrusted Entities that are third parties located in foreign countries, in order to allow the Entrusted Entities to use personal information of users for the purposes set out in this Privacy Policy.

f. Requests for disclosure, etc. of personal information

The Company handles demands for notification of purpose of use, disclosure, correction, addition, deletion, or cessation of utilization (“Disclosure, Etc.”) in regard to personal information of users as follows.

(1) Procedures
a) Please contact the point of contact stated in section h. below (the “Point of Contact”) by mail, telephone, or email.
b) The Company will send the form for Disclosure, Etc. requests to the address or email address you designate (therefore, please provide us with your address or email address).
c) Please fill in the necessary information on the form and mail it to the Point of Contact.
• In addition to filling in the “Personal Information Disclosure, Etc. Request Form,” please include an official document confirming your identity (such as a copy of your driver’s license, residence certificate, health insurance card, etc.).
• If a request is being made by a representative, please include official documents to confirm the identities of the user and the representative as well as a letter of attorney from the user.
d) The Company will confirm the details of your request, promptly conduct checks and processing, and reply to you in writing.

(2) Costs for procedures
Users must pay a fee of 500 yen (including tax) each time they make a request. (Postage fees are also to be borne by the user.)

(3) Cases where we do not provide disclosure
When allowed by laws and ordinances, the Company may not provide Disclosure, Etc. of all or part of the personal information pertaining to your request. If the Company decides not to provide Disclosure, Etc., we will inform you of that fact along with the reason for our decision.

(4) Handling of personal information in connection to requests
The personal information received by the Company in connection to your request, such as your telephone number, email address, request form, and identification documents, will be used only for the purpose of conducting procedures for your request and will be promptly disposed of after the Company finishes processing and replying to your request.
